Luxury Condo Developer Sued For Millions in Damages
A 26-count lawsuit was filed at the close of 2008 against the company that built a luxury condominium complex near Charlestown, MA.
The lawsuit, opened by some of the residents, accuses the condo's developer, Edward A. Fish of breach of contract, negligence and unfair business practices. The high-end condo project named Nautica is a $51 million, 117 unit complex which underwent construction in 2000. Fish contracted a construction company that he owned at the time to build the property, but now residents are suing for at least $3 million in damages.
Tangled in a web of his own companies, Fish reportedly promised the condo residents that the Nautica condos were constructed completely of new, "free from substantial faults and defects" materials and equipment. However, the details of the lawsuit state that the condo trustees believe that the building was defectively built. They report many defects in the structural framing, insulation and roofing systems along with other highlighted issues although it was reported to them at the time that the building was constructed in accordance with approved plans and specifications.
In addition, the complaint accuses some of Fish's other companies of making false representations and warranties as regards the quality of work performed and the materials used in the building's construction.
In their defense, Peabody Properties, the company owned by Mr. Fish appointed to oversee the construction, claim that the statutes of limitation will debunk most of the claims since the construction was completed more than seven years ago.
